User Agreement (Acorn Lantern)

1. Introduction
Welcome to Neighbor Outdoor Lighting, a mobile application("App") designed for the control of the Acorn Lantern, a Bluetooth-powered electronic device. By using this App, you agree to comply with the terms and conditions outlined in this Terms of Use agreement("Agreement"). Please read this Agreement carefully.
2. User Account Information
2.1. To access and use the App, users are required to create accounts. Account creation involves providing your name, and email address, and creating a password. You are responsible for maintaining the confidentiality of your account information.
3. App Usage
3.1. The App allows users to control the brightness levels, power on/off functionality of the Acorn Lantern, and add multiple lanterns for individual or collective control. The App operates when your mobile device is within Bluetooth range of the Acorn Lantern.
4. Data Collection and Privacy
4.1. Data collected by the App is subject to our Privacy Policy. We collect various types of data for multiple purposes, including but not limited to:
- Contact information: Name, email address, and phone number.
- Account information: Username and password.
- Device information: IP address, device type, operating system, browser type, unique device identifiers, and mobile network information.
- Usage data: Interactions with The Acorn Lantern, including preferences, settings, and actions taken.
- Location information: If you grant us access, we may collect your location for specific functionalities.
- Bluetooth Data: Information exchanged between the App and the Lantern during Bluetooth connectivity.
- Correspondence: Records of your communication with us, such as customer support inquiries or feedback.
- Marketing preferences: Your preferences for receiving promotional emails and marketing communications.
- Commercial information, including purchase history and transaction data.
5. Intellectual Property
5.1. The Acorn Lantern device and its intellectual property are owned by Made by Haven, Inc. D.B.A.“Neighbor.” The App is licensed from a third party who owns the intellectual property rights to the App. Made by Haven, Inc. owns the trademark"Neighbor" and holds copyrights and patents for the name"Acorn Lantern." Users do not acquire any rights to our intellectual property.
6. User Conduct
6.1. Users are prohibited from engaging in abusive, offensive, or illegal behavior while using the App. Violation of these guidelines may result in the deletion of user accounts.
7. Payment and Fees
7.1. The App is provided free of charge and does not require payment or fees for basic functionality.
8. Termination of Accounts
8.1. Accounts may be terminated for violations of the terms of service or for extended periods of inactivity.
9. Dispute Resolution
9.1. Disputes arising from the use of the App shall be resolved through litigation in the state of Arizona, USA.
10. Limitation of Liability
10.1. Users are responsible for their actions while using the App and do so at their own risk. The App should not be used in or near water to avoid damage or accidents.
11. Indemnification
11.1. Users are required to indemnify and hold Made by Haven, Inc. harmless from any claims, damages, or liabilities resulting from their use of the App.
12. Changes to Terms
12.1. Users will be notified of changes to the App's terms and conditions. If you do not agree with the changes, you can request the removal of your account from the App's database by emailing us at support@hineighbor.com.
13. Governing Law
13.1. This Agreement is governed by and construed in accordance with the laws of the state of Arizona, USA.

By using the Neighbor Outdoor Lighting App, you acknowledge that you have read, understood, and agreed to the terms and conditions outlined in this Agreement.
